Organizational, Management, and Control Form
The Legislative Decree No. 231/ 2001 introduced company administrative liability into Italian law in case of crimes committed by Subjects (such as Executives, Directors, Employees, or Collaborators) if it can be proven that the company benefited from the commission of these crimes.
The Decree provides for the exclusion of corporate liability if the Company:
- Effectively and efficiently adopts an Organizational, Management, and Control Form aimed at preventing the perpetration of the offences provided by the Decree.
- Appoints an internal supervisory body, with independent powers of initiative and control, with the function of monitoring the effective implementation of the Compliance Program, and its constant updating.
The Board of Directors of M.P.I. MAGNETI PERMANENTI INDUSTRIALI S.R.L. has established a working group to implement the Organizational, Management, and Control Form in compliance with Legislative Decree 231/2001. The working group has created a map that specifically points out the area of risks within the company, drawing up a crime risk analysis.
The adoption of the Form has been shared within M.P.I. MAGNETI PERMANENTI INDUSTRIALI S.R.L.’s structure.
Similarly, the company involves its suppliers, so that they can share the same principles the Form is based on, as outlined in the Code of Ethics.
